SugarNail Copyright Infringement Policy (DMCA Compliance)
Under the guidelines of the Digital Millennium Copyright Act (DMCA), SugarNail has established this policy concerning copyright infringement. We retain the authority to (1) restrict access to or remove any material we conclude to be copyrighted content that has been unlawfully copied and distributed by any parties associated with us (advertisers, affiliates, content providers, members, or users) and (2) terminate services for users who repeatedly violate this policy. Please note that your use of sugarnailart.com is always governed by our Terms of Service, which explicitly includes this Copyright Dispute Policy. Any undefined terms in this Policy carry the meaning ascribed to them in the Terms of Service.
Submitting a Notice of Infringement (Takedown Request)
If you believe that content available on or through our Services infringes your copyright (or the copyright of a party you are authorized to represent), please deliver a written Notice of Infringement containing the following elements to our Designated Agent (contact details provided below):
A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
Identification of the copyrighted work(s) or material(s) claimed to have been infringed;
Precise identification of the material claimed to be infringing, including its location within our Services, with sufficient detail to allow us to locate and verify the material;
A statement confirming your good faith belief that the use of the material identified in (1)(c) is not authorized by the copyright owner, its agent, or the law;
Your contact information, including your address, +1 (209) 266-7591 number, and, if available, your email address;
A statement, made under penalty of perjury, affirming that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
Action Following Receipt of a Valid Infringement Notice
Upon receiving a valid copyright infringement notification, SugarNail reserves the right to take the following actions:
Immediately remove or disable access to the disputed material;
Notify the content provider accused of infringement about the removal or disabling of access to their material; and
Discontinue the infringing content provider's access to the Services if they are determined to be a repeat offender.
Submitting a Counter-Notice
If a content provider believes the material was removed or disabled by mistake or misidentification, or believes they have the legal right to post and use the material, they may submit a counter-notice to the Designated Agent containing the following information:
A physical or electronic signature of the content provider;
Identification of the material that has been removed (or disabled) and the location where the material was visible before the removal or access was disabled;
A statement that the content provider has a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
The content provider's full name, address, +1 (209) 266-7591 number, and, if available, email address, along with a statement consenting to the jurisdiction of the Federal District Court for the judicial district where the content provider's address is located (or any judicial district where sugarnailart.com is located if the address is outside the U.S.), and that the provider will accept service of process from the person who originally filed the infringement notification.
Should a counter-notice be received, sugarnailart.com, at its discretion, may forward a copy to the original complaining party, advising them that SugarNail may reinstate the material or re-enable access within 10 business days. If the copyright owner does not file a court action seeking a judicial order against the content provider within that timeframe, the removed material may be restored in 10 to 14 days or more following receipt of the counter-notice, subject to our final determination.
